Personal Injury

Hawaii Traumatic Brain and Spinal Cord Injury Attorney in Kona and Hilo

With the resources, background, and courtroom experience to take on tough cases that involve serious personal injury in Hawaii, we represent victims of traumatic brain injury and other tragedies that require attorney assistance. Those suffering the ill effects of product defects, medical malpractice, and spinal cord injury also find the help they need in Kona and Hilo at The Law Offices of Robert Marx.

A serious personal injury is described as a disabling injury – permanent or temporary, total or partial – that significantly interrupts a person’s normal lifestyle. The injury could wreak havoc on one’s ability to earn a living, cause substantial pain or disfigurement, and even adversely affect the quality of life for the victim’s family (as is the case when a loved one incurs a brain injury, suddenly requiring round-the-clock care).

Kona- and Hilo-based attorney Robert Marx handles many types of personal injury cases in Hawaii, including:

Traumatic Brain Injury

Generally the result of a forceful blow to the head, a traumatic brain injury can lead to permanent physical disability or difficulty; impairment of mental abilities; and even death. If you or someone you love has suffered in such a way, Hawaii traumatic brain injury attorney Robert Marx can help you obtain compensation for lost wages, pain and suffering, and other damages or losses.

Supported by a network of medical consultants throughout Hawaii, our traumatic brain injury attorney has all the necessary resources to protect our clients’ rights. He can explain the technicalities of such cases in terms that the average person can follow. For example, the compensation to which you are entitled in Hawaii depends on what caused the traumatic brain injury. Our attorney will break down the different rules that apply to injuries caused by motor vehicle accidents, sports injuries, and various forms of negligence. Having represented many victims of traumatic brain injury at his Kona and Hilo offices, attorney Robert Marx always discusses the legal details of accidents and negligence with potential clients to inform them of their rights and assess their case. If you have suffered a brain injury due to someone’s negligence, the Law Offices of Robert Marx can review your case. Contact the top personal injury attorney on the Big Island today.

Spinal Cord Injury

Our Hilo attorney handles many cases that involve spinal cord injury, a disabling condition that occurs when vertebrae in the spinal column are damaged, causing this vital structure to become compressed or injured. Because nerve cells in the spinal cord transmit messages from the brain to the body, any impairment to the system that carries the impulses will inhibit movement, bodily function, and sensation. For this reason, a spinal cord injury is considered one of the most devastating and expensive personal injuries, whether it be the result of a car accident, workplace mishap, or severe impact while participating in a sport.

Tragically, many lives have been severely impacted by spinal cord injury, as Kona- and Hilo-based attorney Robert Marx has witnessed. In fact, approximately 11,000 new spinal cord injury cases are reported each year, according to the National Spinal Cord Injury Database. Those in the Kona and Hilo areas of Hawaii who have suffered a spinal cord injury due to someone else’s negligence are encouraged to contact our personal injury attorney on the Big Island. The Law Offices of Robert Marx may be able to help you obtain just compensation for the great financial, emotional, and physical hardships that result from such a devastating injury.

Serious Automobile Injuries

In the event of a serious automobile injury, it is important to work with an experienced and knowledgeable attorney in this very complex legal area. (Remember, too, that the insurance company and/or other drivers involved in the accident will almost certainly have an investigator and attorney working on their side of the case.) Requiring aggressive and extremely prompt investigation, these cases often call for interviews with victims, witnesses, and police officers, as well as visits to the accident scene to make a note of any roadway or landscaping issues that might have impacted driving conditions. Having an experienced attorney on your side is vital to a satisfactory resolution for you and your family in Hawaii. Even in tragic cases that involve traumatic brain injury or spinal cord injury, Kona attorney Robert Marx can help. Visit our auto accidents page to learn more about this type of case.

Wrongful Death

When someone is killed as the result of someone else’s negligence, the legal term for this tragedy is wrongful death. In such cases, the family members and loved ones of the deceased are entitled to damages including medical bills; funeral and burial expenses; a lifetime of lost income and household services; and any incurred court fees. There are other, less-tangible expenses as well. For instance, did you know that the survivors of a wrongful death victim are entitled to compensation for the loss of love, care, and affection? The staff at The Law Offices of Robert Marx will make sure you understand what you are entitled to in a wrongful death case, and help carry at least some of your burden through this difficult period.

Defective Products

Not every consumer who is injured while using a product has the legal grounds for compensation in court. Someone who falls off a skateboard, for instance, can’t expect the skateboard maker to cover medical costs. If, however, the injured party can demonstrate that a product defect presented an unreasonable and unexpected hazard, then legal action with the help of an experienced product defects attorney is recommended. For a sampling of the types of product defect cases we handle at The Law Offices of Robert Marx, visit our Defective Products page.

Medical Malpractice

Medical malpractice covers many types of preventable errors at the hands of medical professionals. Though the resulting damages could be as straightforward as a temporary injury, more severe cases could result in anything from permanent disability (such as spinal cord injury) to wrongful death. Kona attorney Robert Marx’s medical malpractice work helps recover financial losses, including medical expenses, the cost of long-term hospital or in-home care, lost wages, and punitive damages. A good attorney will not only help a victim put a dollar value on their situation but also carry out the complex investigation needed to gather evidence for a successful case.

Construction Site Injuries

Construction sites and building projects have inherent dangers that require careful site management and supervision. When those responsible fail to protect their employees (and anyone else who happens to be in the vicinity) from undue harm, they can be held liable for any injuries that result. A construction accident could come in the form of a fall, electrocution, exposure to toxic or harmful materials, or an equipment-related injury. If you or someone you love has been seriously injured in a construction accident in Hawaii resulting in any type of damage, from traumatic brain injury to emotional/financial hardship, contact our attorney on the Big Island today.

What is a tort threshold?

Personal injury law is also called tort law, and tort threshold is an important aspect of personal injury litigation. A tort threshold is a way of defining and putting limits on accident victims bringing suit for pain and suffering. No-fault laws include a tort threshold to reduce insurance injury costs – which means that if a person’s injuries fall below the state’s established threshold, then he or she only recovers for economic losses associated with the injury. Non dollar-amount losses such as pain and suffering are not compensated.

Higher monetary tort thresholds could give claimants some incentive to “build up” minor personal injury claims in an effort to exceed the threshold limit and gain the right to sue. States that employ verbal thresholds (limiting suits by wording instead of dollar amounts) are believed to have more effective no-fault laws. In these states, “serious” injury might be described by words such as bone fracture, serious disfigurement, traumatic brain injury, permanent disability, or death – which makes it difficult to artificially build up a medical bill to gain the right to sue. Contact The Law Offices of Robert Marx if you have questions about tort threshold in Hawaii as it pertains to traumatic brain injury or any other condition.

If you live on the Big Island of Hawaii and are the victim of a serious personal injury (such as spinal cord injury or traumatic brain injury) our attorney can evaluate your case at his Kona or Hilo office.
